General Terms and Conditions (AGB)
§ 1 Scope
(1) These terms apply to all contracts for digital products (e.g. download packages, templates, configurations, personalised PDF reports) and digital services (e.g. reviews, analyses, website audits such as the AI Readiness Audit) concluded via lab.anonyfox.com between Anonyfox e. K., Inhaber Maximilian Stroh, Zehntland 2d, 21079 Hamburg (the “Provider”) and the customer.
(2) Customers may be consumers (§ 13 BGB) or entrepreneurs (§ 14 BGB). Deviating terms of the customer do not apply unless the Provider expressly agrees in writing.
§ 2 Formation of the contract
(1) The presentation of offers is not a binding offer. (2) By completing the order process through Stripe Checkout (“Order with obligation to pay” or similar), the customer makes a binding offer. The contract is concluded when the Provider confirms the order by email or makes the product available. (3) The contract language is German; offers may additionally be presented in English. The contract text is not stored separately; the customer receives the order details and these terms by email.
§ 3 Prices and payment
(1) All prices are final prices in euros. No VAT is charged under § 19 UStG (German small business regulation). (2) Payment is made in advance through Stripe using the payment methods offered there. An invoice without VAT is sent electronically.
§ 4 Performance and provision
(1) Digital content is provided by download link or email after payment is received. Personalised digital content (e.g. astrology reports based on the birth details supplied or calculation reports based on the apartment or building details supplied) is delivered by email within the stated period. (2) Digital services are performed within the period stated in the product description; the customer must provide the necessary information and access for this purpose. (3) The customer receives a non-exclusive, non-transferable right of use for an unlimited period for their own purposes (for entrepreneurs: for their own business). Resale and public sharing are not permitted. As an exception, the customer may share and resell the reports and files supplied in the AI Visibility Agency Package to their own customers, provided the notice “Created with Anonyfox Lab” is retained. (4) For analyses and audits (e.g. Repo Audit, AI Readiness Audit, Schema & llms.txt Package, AI Visibility Sample, AI Visibility Complete, Agency Package), the Provider owes the preparation of the described report using the stated method, rather than a particular result such as search engine positions or mentions in AI answers. Only publicly accessible content is checked; the robots.txt of the website being checked is respected. If the specified website is inaccessible or blocked for the crawler, the Provider refunds the full price. The AI Visibility Sample is a sample from the web search of the AI agent used by the Provider; it does not reproduce results or rankings from ChatGPT, Perplexity, Gemini, Google or other services. The 30-day recheck in the “AI Visibility Complete” package is a single repeat check of the same domain. In the Agency Package, domains not yet specified may be submitted by email within 6 months of purchase; the customer may only have domains checked for their own websites or on behalf of their customers.
§ 5 Right of withdrawal and early expiry
(1) Consumers have a right of withdrawal in accordance with the withdrawal instructions. Entrepreneurs have no right of withdrawal.
(2) Digital content (downloads, templates, configurations and PDF reports not supplied on a tangible medium): The consumer’s right of withdrawal expires under § 356(6) BGB if the Provider has begun performance after the consumer (a) expressly consented to the Provider beginning performance before the withdrawal period expires and (b) confirmed their knowledge that, by giving consent, they lose their right of withdrawal when performance begins, and the Provider (c) has provided the consumer with the contract confirmation under § 312f BGB. The customer gives consent and confirmation at the Stripe checkout; the contract confirmation follows by email.
(3) Individually produced digital content (e.g. horoscope and calculation reports based on the customer’s details): There is no right of withdrawal for this under § 312g(2) no. 1 BGB; alternatively, paragraph 2 applies.
(4) Digital services (e.g. audits): The right of withdrawal expires under § 356(5) no. 2 BGB if the Provider has fully performed the service and only began performance after the consumer expressly consented and confirmed their knowledge that the right of withdrawal is lost upon full performance of the contract.
§ 6 Warranty
(1) The statutory provisions apply to consumers, in particular §§ 327 et seq. BGB for digital products, including the obligation to provide updates under § 327f BGB. (2) For entrepreneurs, the limitation period for claims for defects is one year from provision; this does not apply to claims under § 7.
§ 7 Liability
(1) The Provider’s liability is unlimited for intent, gross negligence, injury to life, body or health, and under the Product Liability Act. (2) For a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded. (3) Content such as agent rules, configurations, review recommendations or astrology reports constitutes technical or interpretative guidance for self-reflection; implementation and verification are the customer’s responsibility. Astrological interpretations contain no guarantee of events and do not replace advice. (4) Reports such as the Rent Index Check and CO2 Cost Allocation are automated calculations based on public data and the customer’s details. They are for information and do not constitute legal or tax advice. The customer is responsible for the accuracy of their details. The Hamburg residential location register in the version queried applies to the residential location. (5) The Hamburg Regulation Check (free query and PDF checklist) is an automated preliminary classification based on public geodata from the Free and Hanseatic City of Hamburg at the stated data date and the customer’s details. It is neither legal advice nor binding information on the existence or absence of permit requirements, listed monument status or pre-emption rights. Area boundaries are checked for the official address point, not for the land parcel. Only the competent authorities (in particular the district office, monument protection office and land registry) make binding decisions. (6) The Pillar 3a Sequence Sheet (free check and PDF) is an automated checklist based on published Swiss rules and information from authorities as of the stated date and the customer’s details. The Provider is a German developer and is neither a Swiss tax adviser, a pension institution nor a public authority. The sheet is not tax, legal or investment advice and does not provide binding information; the 3a institution decides whether a buy-in is accepted, and the competent tax office decides on tax recognition. Deadlines, payment methods and amounts must be checked with the provider and the authorities; changes in the law after the stated date are not taken into account.
§ 8 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of protection under mandatory provisions of the state of their habitual residence. (2) If the customer is a merchant, a legal entity under public law or a special fund under public law, Hamburg is the exclusive place of jurisdiction. (3) The EU online dispute resolution platform was discontinued on 20 July 2025. The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body. (4) If individual provisions are invalid, the rest of the contract remains effective. (5) Information on the processing of personal data is provided in the privacy policy.
